PRIVACY POLICY (INCLUDING THE COOKIE POLICY)

We place great importance on respecting your privacy and are committed to building strong, lasting relationships with you.

On this page, you can consult the full Privacy Policy and Cookie Policy of the website(s): www.mikipedia.fr, hereinafter referred to as the "Houseofsho Websites". The "Houseofsho Websites" do not include any third-party platforms they may use (for example MailChimp or Shopify).

The "Houseofsho Websites" are hosted by Shopify (Shopify Inc.), whose data centres are located in Canada.

1. INTRODUCTION

This Privacy Policy explains how we collect, process, use and disclose your personal data when you visit the Houseofsho Websites (your "Personal Data"). You will also find out why we process it and on what legal basis.

We pay close attention to compliance with applicable legislation on this matter, including in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR"), the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, and Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector.

2. WHO ARE WE?

Personal Data is collected via the Houseofsho Websites by the company Shauna Dewit, a private limited liability company (SRL) under Belgian law (acting as data controller and referred to hereafter as "we", "our" and "us"), with registered office at Rue Bara 175, 1070 Anderlecht, Belgium, registered with the Crossroads Bank for Enterprises (BCE) under number 1001.819.958, VAT BE1001.819.958.

Any request relating to the processing and retention of your Personal Data that we carry out can be sent to our team via the "?" button at the bottom of the site.

3. PROCESSING ACTIVITIES: what Personal Data is currently processed, why, and for how long?

Our content is generally accessible on the Houseofsho Websites without any need to register as a user. However, you may be asked to register or provide certain information via the Houseofsho Websites on specific occasions (for example, when you subscribe to a newsletter, enter an online contest, or make purchases). The Houseofsho Websites may also collect your Personal Data even without registering as a user, for example your IP address, as explained herein.

a. Processing of your data when placing an order on the Houseofsho Websites

Only the personal data that you voluntarily provide to us in connection with ordering items for sale on the Houseofsho Websites is saved and stored digitally by us and/or our processors.

The data processed when placing an order is as follows:

  • first and last name,
  • delivery address,
  • billing address,
  • telephone number (so we can contact you more easily in case of an issue with the order or with delivery),
  • where applicable, the size of ordered items,
  • email,
  • company details if the order is placed by a business or delivered to a company's registered office,
  • banking details (cardholder name, credit/debit card type, card number, card expiry date, CVC code, etc.).

Processing this personal data is necessary for the performance of the contract (or any pre-contractual measures) concluded between us, in accordance with Article 6.1(b) of the GDPR; this includes ensuring, among other things:

  • management and follow-up of an information request,
  • invoicing,
  • payment for the order,
  • management of orders and their delivery,
  • handling of issues,
  • management of returns, in particular following the exercise of the right of withdrawal,
  • management of legal proceedings.

Without this data, the contract cannot be performed.

We retain this data (excluding banking data) until the expiry of the limitation period applicable to contractual matters under the applicable legislation. Your processed banking data is kept for the time necessary to carry out the transaction and to ensure compliance with legal obligations and dispute resolution (including any refund). We reserve the right to retain your data for a longer period in any case where this would be necessary in accordance with Article 17.3 of the GDPR.

Subject to what is set out in this Privacy Policy, we will not disclose any of this Personal Data to third parties, nor use it for commercial purposes, except where applicable to send you information relating to the Houseofsho Websites and their content, if you have expressed a wish to receive the Houseofsho newsletter (see point c. below on the newsletter), and to our processors for the performance of our contracts with you, among other things.

Payment for your orders is processed via Shopify Payments and Paypal (Bancontact – credit card); your Personal Data (including your banking data) is processed directly by these services: we refer you to their privacy policies for more information.

You are invited to check that these documents and links have not been changed. If necessary, you are invited to search for any new links to them yourself.

b. An account

You can create an account (hereinafter referred to as a "Member Account") from the profile icon at the top left of the homepage by clicking the "sign up" link, or when placing your order by clicking the "log in" link; this will allow you, among other things, to place your subsequent orders on the Houseofsho Websites without having to re-enter all your data each time.

The personal data processed for creating the Member Account is the data provided when creating the Member Account, namely:

  • first and last name,
  • telephone number (for registering for the Mikipedia newsletter),
  • address,
  • billing address if different from the delivery address,
  • email,
  • order history.

Providing certain information may be optional. You are invited to complete the form, in which some fields marked in bold and/or followed by an asterisk (*) must be completed in order to place an order and become a member (hereinafter "Member"), while others are optional.

The identification information recorded (namely first and last name, telephone number, billing address, delivery address and email) is available on the "Your account" and "Addresses" pages accessible from the Member Account. You can therefore modify this data directly in your account; you agree to keep it up to date.

This data processing is based on your consent, in accordance with Article 6.1(a) of the GDPR. You may withdraw it at any time, without affecting the lawfulness of processing carried out prior to such withdrawal: you can unsubscribe from the Mikipedia Websites and close your Member Account by sending a message to our team via the "? help" button at the bottom of the site.

Your personal data is retained for as long as you remain registered as a Member on the Houseofsho Websites and have not withdrawn your consent to the processing of your Personal Data.

With regard to the Member Account, the purposes of processing are as follows:

  • registration, maintenance and authentication of the Member Account, which is used in particular to place an order more easily on the Houseofsho Websites;
  • to keep a record of Members;
  • to manage and follow up an information request, and to resolve an issue;
  • to enable you to place orders and access your order history.

As part of registering as a Member:

  • You must provide accurate and complete identification information and undertake to update it regularly. As a Member, you can update your identification information at any time.
  • You must choose a username and password that will allow you to access your Member Account. This password is intended to protect personal data. It must remain confidential. We ask that you never share or disclose your password to anyone. You are responsible for any use of the Houseofsho Websites by anyone using your username and password. You must notify us immediately if you have reason to believe that your username and password have been compromised. As a precaution, it is advisable to log out of your Member Account at the end of each session.
  • It is prohibited to use an email address that infringes the rights of third parties and, in particular, the right to a name, trademark rights, copyright, related rights, or which is otherwise contrary to any applicable regulations, public order or accepted standards of morality.

c. The Houseofsho Newsletter (via Shopify)

If you would like to be informed about Houseofsho's projects and receive our newsletter, it's very simple: sign up either when creating your Member Account or when placing your order via the Houseofsho Websites, by email, by filling in the box provided for this purpose.

If you would like to stay informed of Houseofsho's news by SMS, simply fill in the phone number field when creating your Member Account. Otherwise, leave this field blank.

You will then receive information related to its activities, such as, for example, new product launches, tour details, special events, information on possible humanitarian projects, or marketing communications, contest launches, etc.

We process your email and, if you have agreed to provide it, your phone number, when you voluntarily sign up for the newsletter. The following data may also be processed: your operating system, your browser ID and other information about your system and connection, as well as your interactions with the emails we send you (what you click on, when and where you click, etc.).

This processing is based on your consent, in accordance with Article 6.1(a) of the GDPR, and your data is only used to manage Houseofsho newsletter subscribers, send the newsletter, and improve it.

You may withdraw your consent to this processing of your personal data at any time, without affecting the lawfulness of processing carried out prior to such withdrawal. The newsletter will include a link allowing you to unsubscribe from future communications. Likewise, each SMS will specify the procedure for unsubscribing.

This data is retained for as long as we send newsletters and you have not withdrawn your consent to receive them.

d. Other possible processing we may implement

We may use your Personal Data (sometimes even without your explicit consent) to improve your user experience, as well as to administer online contests, verify your eligibility for a contest or otherwise, and for the fulfilment, delivery and organisation of a prize.

We may collect usage information about you, such as your IP address and information on how you interact with our Houseofsho Websites (the pages you visit, the links you click, and the duration of your visits).

We will inform you of this in due course.

e. Third-party disclosure and automated decision-making

Subject to what is set out in this Privacy Policy, none of your collected Personal Data is disclosed by us to third parties (other than our processors). We do not carry out automated decision-making based on your personal data.

We do not process your Personal Data where your data protection interests or your fundamental rights and freedoms override the legal basis for our processing. We do not collect or process any other special category of Personal Data concerning you, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or other beliefs of a similar nature, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, health data, or data concerning sex life or sexual orientation.

4. HOW DO WE COLLECT YOUR DATA?

We collect Personal Data about you in various ways:

  • By registration: subscribing to our newsletters requires you to sign up voluntarily and provide us with your email address and, where applicable, your phone number.
  • By contact: In some cases, you may contact us regarding press-related questions and provide optional data such as your company address, phone number (office, mobile, private), fax number, job title, gender, date of birth, interests, profile photo, links to your social media profiles, and job title.
  • By cookies, pixels: We may also collect certain information when you visit our Houseofsho Websites (including as an unregistered user), through cookies, pixels and similar technologies; information on how we use them and the types of information collected through cookies is described in detail below.

5. HOW DO WE USE YOUR PERSONAL DATA (the purposes of processing)?

Your Personal Data will be used exclusively and only to the extent necessary, for the following purposes:

  • Online contests: to run the online contest, contact you about the prize and/or inform you of the final winner.
  • Responses to requests: to respond to your direct requests, based on your specific consent, as indicated when we collect your Personal Data or as otherwise explained before using your Personal Data.
  • Album release information: to provide you with updates on Houseofsho's album releases.
  • Merchandise sales: to process your orders and deliver merchandise to you.
  • Humanitarian projects: to inform you about various humanitarian or non-profit projects and how you might contribute to them.
  • Event invitations: to send you invitations to studio sessions, events and tours.
  • Improvements: based on your specific consent to the associated cookies, to analyse and understand the experience and habits of the Houseofsho Websites' audience, improve the Houseofsho Websites' service (including the user interface experience and performance of the Houseofsho Websites), and optimise content selection and recommendation algorithms.

We will not use your Personal Data for new purposes not provided for in this Privacy Policy, except to comply with a legal obligation. In all cases, before using Personal Data for other purposes, our Privacy Policy will be updated and we will inform you of the change. For consent-based activities, we will not process your Personal Data for new purposes without first obtaining your consent.

6. CONTESTS AND ONLINE SALES

As part of administering the online contests in which you voluntarily participate, the collection, use and processing of Personal Data may be carried out by a third party, including our partners Waltex SRL and/or Mataro Advice SRL. We may also contact you after the online contest to provide you with information about similar or future events.

7. SHARING PERSONAL DATA WITH THIRD PARTIES AND TRANSFERRING PERSONAL DATA TO THIRD COUNTRIES

a. We select our processors (hosting providers, email campaign managers, services and tools, Houseofsho Websites manager, etc.) with care and ensure that they guarantee compliance with GDPR rules. We work in particular with Waltex SRL and Mataro Advice SRL.

When we transfer your personal data to our processors, we do so only on the basis of an agreement with our processor that limits the use of this Personal Data to the processing necessary to fulfil the processing contract, and which requires them to take the necessary security measures regarding this data. However, we are not able to verify the actions or omissions of our processors and cannot be held liable for them.

We will not make your Personal Data available to third parties (other than our processors) and will not publicly disclose Personal Data, unless such transfers are based on your specific consent, are necessary for the performance of a contract concluded between you and us, or where such transfer of Personal Data is otherwise authorised or required by law or by order of an administrative or judicial authority.

b. Your processed Personal Data may be stored on servers located outside, and/or may be transferred outside, the European Union, in accordance with Articles 44 et seq. of the GDPR; such transfers of Personal Data outside the European Union are based on the existence of regulations considered to comply with the GDPR in the country where the data is stored, or on the existence of an adequacy decision, or appropriate safeguards (as provided for in Articles 46 et seq. of the GDPR), including the European Commission's standard contractual clauses, binding corporate rules, etc.

Please note that whenever your Personal Data is transferred to processors or third parties located in countries outside the European Economic Area that are not considered by the European Commission to guarantee an adequate level of protection for Personal Data, we will ensure that appropriate measures are implemented in accordance with applicable national and European data protection legislation.

8. USE OF COOKIES

You are informed of our cookie policy through the information banner that appears on our Houseofsho Websites when you visit.

We want browsing and using our Houseofsho Websites to be easy and pleasant, and we use cookies for this purpose, among others.

Cookies are small text files that are automatically placed on your computer or other device by the websites you visit, where applicable after obtaining your consent. They are widely used to make websites work, or to make them more efficient, as well as to provide information to website owners. They are stored locally on your device for varying periods of time.

What types of cookies are used on our Mikipedia Websites?

Cookies necessary for browsing: our Houseofsho Websites place cookies to ensure the security of our Houseofsho Websites, and to be able to store information such as your choice regarding whether or not to place cookies, etc.

These cookies are necessary for the proper functioning of our Mikipedia Websites and cannot be refused if you wish to visit the site.

The cookies used have defined expiry periods that vary depending on the cookie. They will automatically be deactivated once their respective period expires, and the information they contain will automatically be deleted.

In certain sections of the Mikipedia Websites, we may provide links to third-party websites (such as the websites of our sponsors and partners), YouTube, Spotify, and social media platforms (such as, but not limited to, Facebook, X, Instagram) which are not subject to this Privacy Policy.

These links are provided for your convenience; however, you acknowledge that we have no control over these third parties or their websites, and that they will have a different privacy policy applying to information collected about you when you are on their websites.

By clicking these links, you leave the Mikipedia Websites. We therefore disclaim all liability, in particular regarding the content of these third-party sites and any contractual relationship you may enter into with third parties. You access them of your own free will and at your own risk, without prior warning, and we encourage you to carefully read the privacy policy of any website before providing personally identifiable information.

We draw your attention to the fact that they may be owned and operated by companies established outside the European Union; they may be governed by legislation that is less protective with regard to the processing of your Personal Data than European legislation on this matter.

10. RETENTION PERIOD

We retain your Personal Data for as long as necessary to achieve the purposes described above, or as required by applicable data retention laws and legal limitation periods for claims.

Where your Personal Data is processed for the purposes of an online contest, we will retain your Personal Data for the duration of the contest.

11. SECURITY AND CONFIDENTIALITY

We do everything possible to ensure the security of the Personal Data processed.

You agree and are aware that the Internet is not an entirely secure means of communication, and that consequently, a full guarantee of privacy protection cannot be assured. Our commitment is therefore limited to a best-efforts obligation of a prudent and reasonable person, not an obligation of result.

We have implemented technical and organisational measures in line with standard industry practices to ensure an adequate level of security for the Personal Data processed. The Mikipedia Websites are secured using SSL encryption.

Nevertheless, security requires effort from all parties involved. We therefore encourage you to contribute to these efforts by taking your own appropriate security measures, including using strong passwords and keeping any usernames and passwords confidential (where applicable).

12. CHILDREN ON THE MIKIPEDIA WEBSITES

The Houseofsho Websites may be accessed by anyone.

However, if you are under 18, participation in an online contest or a sales transaction is strictly prohibited. Furthermore, by subscribing to the newsletter, you acknowledge that you are over 16.

If you are under 16 and wish to receive any of our promotional emails and/or SMS messages, please ask your parents to subscribe on your behalf. If you are the parent or guardian of a child under 16 and believe or discover that your child has provided us with information without your consent, please contact us at sav@waltex.be.

13. YOUR RIGHTS

Applicable regulations guarantee you the exercise of rights regarding the use of your personal data.

At any time, you may exercise your right to request access to your Personal Data, its rectification (i.e. correcting or updating inaccurate or incomplete Personal Data) and, where applicable, its erasure, within the limits set out in Article 17 of the GDPR. You may also request a restriction (temporary or permanent) of the processing of Personal Data, in whole or in part, within the limits set out in Article 18 of the GDPR.

You may also object to processing: the right to object allows you to refuse the processing of your Personal Data, without affecting the lawfulness of processing carried out prior to such objection, and within the limits set out in Article 21 of the GDPR. The right to object may apply to certain categories of communications. If you no longer wish to receive the newsletter, you can, for example, unsubscribe from communications by clicking the link included in the emails you have received.

You also have the right to receive a copy of certain personal data collected in a structured, commonly used and machine-readable format (e.g. a PDF document), or to request that this data be transmitted directly to another data controller where technically possible (right to data portability), within the limits set out in Article 20 of the GDPR.

You also have the right to lodge a complaint with a supervisory authority (in particular in the EU member state of your habitual residence, your place of work, or the place where the infringement occurred) if you consider that the processing of Personal Data concerning you infringes applicable data protection legislation; in Belgium, the contact email for this supervisory authority is: sav@waltex.be.

14. EFFECTIVE DATE AND AMENDMENTS

This Privacy Policy, in its original version, has been in effect since 30 May 2024. We reserve the right, at our sole discretion, to change, modify, add to, or delete all or part of this Privacy Policy at any time without notice, by publishing the amended version of the text on the Houseofsho Websites. We encourage you to check this page regularly to stay informed of the most recent version of this Privacy Policy.

This Privacy Policy only covers the management of Personal Data that we carry out and that is under our exclusive control. You are invited to review the privacy policy of our partners, for which we cannot be held responsible.

Should one or more clauses of this Privacy Policy be deemed null and void, only the minimum necessary shall be considered void and shall be replaced by valid provisions that best respect the purpose of this Privacy Policy in light of the object or effects of the voided clause.

15. APPLICABLE LAW AND DISPUTES

This Privacy Policy is entirely governed by Belgian law, as are all relations between SHAUNA DEWIT and you, in particular regarding the processing of Personal Data that we carry out via the Houseofsho Websites. In the event of a dispute concerning in particular the validity, performance or interpretation hereof, only the French-speaking courts and tribunals of the judicial district of Brussels shall have jurisdiction.
